1. About these terms

These terms govern your use of CookieChest (a trading name of Tailor Made Analytics) and its compliance monitoring services. By subscribing, you agree to these terms.

2. The service

CookieChest provides cookie consent management (CMP), compliance audits, and daily compliance monitoring. The features available to you depend on your subscription plan.

Compliance monitoring

Our monitoring service uses automated synthetic checks (headless browser scans) to assess CMP compliance, Consent Mode v2 status, and GTM container configuration. We also provide a lightweight Real User Monitoring (RUM) script that collects anonymised performance data from your site visitors.

• Scan frequency depends on your plan tier (hourly or daily) and is delivered on a best-efforts basis — not as a guaranteed SLA
• Email alerts are sent when potential compliance issues are detected, such as pre-consent data leakage, missing Consent Mode signals, or GTM container changes
• Alerts are informational only — monitoring does not include fixing issues
• Scan results are stored as historical snapshots for compliance tracking

RUM script

Where the RUM script is installed on your site, it collects anonymised performance metrics (page load times, core web vitals) from your visitors. By installing the script, you accept responsibility for disclosing this data collection to your users via your own privacy policy and cookie banner where required.

Audits

Compliance audits are performed on a best-efforts basis. An audit reflects the state of your website at the time of testing and cannot guarantee detection of every issue, particularly those caused by intermittent behaviour, third-party changes, or conditions not present during the scan.

Dashboard access

Where a compliance dashboard is provided, access is limited to authorised users on your account. Dashboard credentials must not be shared with third parties without our written consent.

3. Subscriptions and billing

• All subscriptions are for a minimum term of 12 months
• Billing is monthly or annual via Stripe
• Prices are in GBP and exclusive of VAT where applicable
• Beta pricing is guaranteed for 12 months from the end of the beta period

4. Your responsibilities

• Provide accurate website URLs and contact information
• Maintain valid payment details
• Act on compliance alerts in a timely manner (we alert, you fix)
• Ensure you have authority to install scripts on the monitored website
• Disclose the RUM script in your site's privacy policy and cookie banner where applicable

5. Agency and reseller terms

Agency and white-label arrangements are available on request under a separate agreement. Where you resell or rebrand CookieChest services to your clients:

• You remain responsible for your end clients' compliance obligations
• You must not misrepresent the scope of the monitoring service
• Data handling between you and your clients is your responsibility — CookieChest acts as a processor on your behalf

6. Data retention

Monitoring scan snapshots are retained for the duration of your subscription plus 90 days. After account closure, scan data is deleted within 90 days. Contact form submissions are retained for 12 months.

7. Limitation of liability

CookieChest provides compliance tooling including audits, monitoring, and alerting. We do not guarantee full regulatory compliance. Our services help identify potential issues on a best-efforts basis but do not constitute legal advice. Audit and monitoring results reflect conditions at the time of testing. To the maximum extent permitted by law, our liability is limited to the fees paid in the 12 months preceding any claim.

8. Termination

• You may cancel after the minimum 12-month term with 30 days notice
• Early termination requires payment of remaining months in the minimum term
• We may suspend or terminate accounts for non-payment or misuse

9. Changes to terms

We may update these terms from time to time. Material changes will be communicated via email at least 30 days in advance.

10. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
